Terms of Service

Last updated

These terms are the agreement between you and GetSite, who runs PlayNerva. By creating an account or using the site you accept them, together with the Privacy Policy and the Content Policy.

The short version

  • You describe a game, our AI builds it, and you can play, change and publish it.
  • The games you make are yours. Publishing one lets us host and show it, and lets others remix it if you allow that.
  • Credits pay for AI work. They aren't money, and you get them back when a build fails.
  • AI output can be buggy or look like other people's work. Check what you publish.
  • Follow the Content Policy or we may remove your games or your account.

What is PlayNerva?

PlayNerva is a website where you describe a game in words and AI models build it as a game that runs in the browser. You can keep changing it by chatting, make a cover picture, a trailer or an automated playtest for it, publish it for others to play, and remix games other people have published.

Games run in a sandbox on a separate domain. They are made by players with AI, not by us, and we don't check every game before it goes live.

We're improving PlayNerva all the time, so features may change, be limited or be removed. If we ever shut the service down, we'll give at least 30 days' notice on the site and by email.

Who can have an account?

You must be at least 16 years old to create an account. If the law where you live requires a higher age to agree to these terms or to the use of your data, you need to meet that age or have a parent's or guardian's permission.

You sign in with a link we email you, or with Google or GitHub where offered. Keep your email account secure: anyone who can read it can sign in as you. One account per person, please, and don't create accounts to get extra free credits or to get around a ban.

Your handle and display name are public. Don't use a name that impersonates someone else or that you don't have the right to use.

How do credits work?

Credits pay for the AI work PlayNerva does for you: building and changing games, cover pictures, trailers and playtests. New accounts get free credits to start.

  • Prices are shown before you start. The studio tells you the price, or the most a job can cost, before you confirm it.
  • Builds and playtests are held, then settled. When you start one, we set aside its maximum. When it finishes we charge for the work actually done, never more than the amount held, and give back the rest.
  • Failures are free. If a build fails for any reason, you cancel it, or it changes nothing, the whole hold goes back to your balance. A cover picture or trailer that doesn't come back is refunded. A playtest that fails or that you stop is released.
  • Credits aren't money. They have no cash value, can't be sold, transferred or exchanged for cash, and can only be used on PlayNerva. They don't expire while your account is open.
  • Bought credits. Credit packs are sold by Lemon Squeezy, our reseller and merchant of record: it takes the payment, charges any sales tax or VAT and sends your receipt, under its own buyer terms. The price and amount are shown at checkout. Purchases are final, except where the law gives you a right to a refund or where there's been a billing mistake; ask Lemon Squeezy or write to us and we'll sort it out.
  • No paid games or payouts. Every game on PlayNerva is free to play. You can't sell your games here, and we don't pay creators.

If we close your account for breaking these terms, any credits left on it are lost. If we shut PlayNerva down, we'll refund credits you bought and haven't used.

Who owns the games I make?

You do. As between you and us, you own the games, prompts, descriptions and other things you create or upload on PlayNerva, to the extent the law lets anyone own them. We don't claim ownership of your games.

To run PlayNerva we need some permission from you. You give us a worldwide, non-exclusive, royalty-free licence to store, host, copy, run, display and adapt your games and the material around them (covers, screenshots, trailers, descriptions) in order to operate, show and improve PlayNerva, and to promote PlayNerva and your game, for example by featuring it on the home page or in a social post.

This licence lasts while your game is on PlayNerva and for a reasonable time afterwards while copies are removed from our systems. It also continues for remixes others made while you allowed remixing, and for anything already shared before you removed it.

Drafts and private games are visible only to you and to us when we need to operate or moderate the service. Unlisted games can be played by anyone with the link. Public games are listed in the catalog, on your profile and in search engines.

How does remixing work?

When you publish a game you choose whether others may remix it. Remixing is on unless you turn it off. If it's on, you allow every PlayNerva user to copy your game, change it and publish the result on PlayNerva, on these conditions:

  • Attribution. A remix always credits you and links back to your game. PlayNerva does this automatically.
  • Share-alike (if you tick “Remixes must be remixable too”). A remix carries the same licence, so others can remix it in turn.

Turning remixing off later stops new remixes but doesn't affect remixes already made. When you remix someone else's game, you accept the licence its creator chose, and your remix carries it.

What should I know about AI-made games?

Games are written by AI models from your prompts. We can't promise that a build works, matches what you asked for, is free of bugs, or is suitable for any purpose.

AI output can resemble existing games, characters, music, art or code, including things other people own. You are responsible for what you publish. Don't ask for a copy of someone else's game, characters or brand, and check your game before you publish it. If we're told a game infringes someone's rights, we'll follow the copyright process.

Leaderboards show scores that games send. They aren't verified and may be wrong or gamed.

What am I not allowed to do?

Everything you make, publish, post or report must follow the Content Policy. You also agree not to:

  • break the law, or help anyone else do so, using PlayNerva;
  • make games that attack players or other sites: malware, phishing, scams, crypto mining, or tricking players into giving passwords or personal details;
  • try to get around the sandbox, credit limits, rate limits, prompt screening or a ban, or probe, overload or break the service;
  • scrape PlayNerva in bulk, or use it to build a competing service or train AI models, other than through features we offer for that;
  • use automated means to fake plays, scores, reports or accounts.

How do you moderate?

We screen prompts before we build anything and may refuse ones that break the Content Policy. Players can report games, and a game reported by several different accounts is unlisted automatically until we look at it.

We may unlist, unpublish or remove any game, refuse a prompt, remove a leaderboard entry, limit features, adjust credits given in error, or suspend or close an account when we reasonably believe something breaks these terms, the Content Policy or the law, or puts players or PlayNerva at risk. Where we can, we'll tell you what we did and why. If you think we got it wrong, write to [email protected].

How can my account end?

You can stop using PlayNerva at any time, and ask us to delete your account by writing to [email protected] from the email you sign in with. We may suspend or close your account if you seriously or repeatedly break these terms, if the law requires it, or if we shut PlayNerva down. The sections on ownership and licences, disclaimers, liability and disputes continue to apply after your account ends.

What are you responsible for?

PlayNerva is provided “as is” and “as available”. To the extent the law allows, we make no promises about it, including that it will be available, error-free or secure, or that games made or played on it are accurate, safe or fit for a purpose. Games are made by players, and we are not responsible for what they contain or do.

To the extent the law allows, we aren't liable for indirect or consequential losses, lost profits or lost data, and our total liability to you for any claim is limited to the greater of what you paid us in the 12 months before the claim and 50 US dollars.

Nothing in these terms limits liability that can't be limited by law, such as for fraud or for death or personal injury caused by negligence, or takes away rights you have as a consumer.

Can these terms change?

Yes. We'll post the new version here and change the date at the top. If a change matters to you, for example to prices or your rights over your games, we'll tell you by email or on the site at least 14 days before it applies. If you keep using PlayNerva after that, you accept the new terms. If you don't, you can close your account.

Which law applies?

These terms are governed by the law of Romania, and the competent courts of Romania handle disputes, unless the law where you live as a consumer gives you the right to go to your local courts or to its own law.

How do I contact you?
